Terms of Service

3.1 Age Requirements: You must be at least 13 years old to use this Service. Users between 13-17 years old must have parental or guardian consent.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account and all activities that occur under your account.

3.3 Accurate Information: You agree to provide accurate and complete information when using our Service.

5.1 Message Storage: We collect and store messages exchanged with our AI characters for the purposes of service improvement, AI model training, and quality assurance.

5.2 Data Use: Your conversation data may be used to enhance our AI models and improve Service quality. We do not sell your personal conversation data to third parties.

5.3 Content Ownership: You retain ownership of content you create. By using our Service, you grant us a non-exclusive license to use, process, and analyze your messages for service improvement.

5.4 AI-Generated Content: Content generated by our AI characters is owned by KosmosAI. You may use AI-generated content for personal, non-commercial purposes.

7.1 Service Availability: We strive to provide continuous service availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience technical difficulties that temporarily affect service availability.

7.2 Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

7.3 Terms Updates: We may update these Terms periodically. Continued use of the Service after updates constitutes acceptance of the new Terms.

8.1 Payment: Access to premium AI characters and B2B services may require payment of fees as specified on our website or in the Service.

8.2 B2B Services - No Refunds Policy: All payments for B2B chatbot solutions, custom AI development, and business services (ranging from ₹20,000 to ₹5,00,000) are final and non-refundable. We do not provide refunds, credits, or pro-rated billing for B2B services for any reason, including but not limited to:

• Dissatisfaction with the service or solution performance
• Technical issues or temporary service interruptions
• Changes to service features or functionality
• Project cancellation or scope changes
• Account termination or suspension

8.3 B2C AI Characters - Limited Refund Policy: For consumer AI character subscriptions and premium features, refunds are available under the following strict conditions:

• Time Limit: Refund requests must be made within 2 days of the initial purchase or subscription activation
• Usage Restriction: Refunds are only available if you have not extracted or used any premium privileges, features, or content from the AI characters
• Verification: We reserve the right to verify that premium features have not been accessed before processing any refund
• Once Only: Only one refund per customer per AI character service is permitted

Note: Any use of premium AI character features, exclusive content, or advanced interactions will void refund eligibility permanently.

8.4 Billing: Subscription fees are billed in advance on a recurring basis according to your chosen plan. You are responsible for ensuring payment method validity.

8.5 Price Changes: We reserve the right to modify pricing at any time. Changes will be communicated in advance and will not affect your current billing cycle.

8.6 Cancellation: You may cancel your subscription at any time. For B2B services, no refunds will be provided. For B2C AI characters, refunds are subject to the conditions outlined in section 8.3. Service access will continue until the end of your paid period.

8.7 Refund Processing: For eligible B2C refunds, if a refund is approved, it will be processed and credited within 7-10 business days to your original payment method. B2B services remain non-refundable as specified in section 8.2.

9.1 Entertainment Purpose: Our AI characters are designed for entertainment, role-playing, and casual conversation. They are not real people and their responses are generated by artificial intelligence.

9.2 No Professional Advice: AI characters cannot provide professional advice (medical, legal, financial, therapeutic). Do not rely on character responses for important life decisions.

9.3 Response Limitations: Characters may occasionally generate inconsistent, inaccurate, or unexpected responses due to the nature of AI technology.

9.4 No Emotional Relationships: While characters may seem engaging, they are not capable of genuine emotions or real relationships. Please maintain healthy boundaries.

9.5 Limitation of Liability: KosmosAI is not liable for any emotional distress, misconceptions, or decisions made based on AI character interactions.

10.1 User Termination: You may terminate your use of the Service at any time by ceasing to use our AI characters.

10.2 Company Termination: We may suspend or terminate your access to the Service immediately, without notice, for any violation of these Terms or for any other reason at our sole discretion.

10.3 Effect of Termination: Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

11.1 GDPR Compliance: For users in the European Union, we comply with the General Data Protection Regulation (GDPR). You have rights regarding your personal data as outlined in our Privacy Policy.

11.2 CCPA Compliance: For California residents, we comply with the California Consumer Privacy Act (CCPA) regarding the collection and use of personal information.

11.3 Other Jurisdictions: We strive to comply with applicable data protection laws in all jurisdictions where our Service is available.

12.1 Company IP: All intellectual property rights in the Service, including AI models, characters, and technology, belong to KosmosAI or our licensors.

12.2 User Content: You retain ownership of your messages and input, but grant us necessary rights to process and improve our Service.

12.3 Respect for IP: You agree not to infringe on the intellectual property rights of others when using our Service.

13.1 Governing Law: These Terms shall be governed by and construed in accordance with applicable international commercial law principles.

13.2 Dispute Resolution: Any disputes arising under these Terms shall be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or competent courts.

13.3 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
